A Response on Social Inequality

? A Response on Social Inequality We live in a culturally diverse world. Age, gender, sexual orientation, ethnic heritage and race are some of the diverse areas in society that are deemed significant. In spite of all these differences we tend to center ourselves around people who are similar to us; those who share the same biological and physical characteristics, same status and similar lifestyles. Because of this it is our human nature to be ethnocentric towards those who are different from us. This gives rise to discrimination which ultimately leads to social inequality. There are many areas in which people discriminate others. One of the most prominent ones is race; since it is easy to identify. Race is related to the distinct biological characteristics of  a person; skin color, hair color, eye shape, height ect. We can easily differentiate an African American from a white American. Another similar area to race is the ethnicity of a person. Ethnicity is the fact or state of belonging to a social group that has a common national or cultural tradition. For example some commonly recognized American ethnic groups include American Indians, Latinos, Chinese, African Americans, European Americans, etc. Discrimination and social inequality on the base of race and ethnicity go hand in hand and is seen all over the world. In the article â€Å"office work and the crack alternative† Philippe Bourgois shows how a group Puerto Rican immigrants in New Harlem face discrimination because of their race. They are deprived of jobs at work places and are stereotyped as lazy and good for nothing. Sex and gender is also another area where social inequality occurs. Gender is the state of being male or female etc. and sex is the category into which humans are divided on the basis of their reproductive functions. We see social inequality on sex and gender in almost all work places where the male usually gets better jobs and a better pay than females and we also see this social inequality in families where the male is the head of the family and holds an authoritative figure. This is mostly due to gender stereotypes. Some common gender stereotypes are that men are stronger, tougher, braver, and more intelligent thus he is given the authoritative role. Women on the other hand are stereotyped as more emotional, sensitive and soft spoken, and nurturing thus she is in charge of taking care of the household duties such as cooking, cleaning, raising the children. In Asian countries it is common to see the male as the â€Å"higher† gender while the woman is seen as lower than them. Caste and class is another area where you see social inequality based on discrimination. Caste is an economic categorization describing the status you are born into. Caste is an ascribed status; you have to stay in your caste from birth on, and it helps determine your job, place and value in society etc. Class is based on economic status; usually upon the income made. While people tend to stay in the class they are brought up in, it is possible to move up or down the class scale therefore it is an achieved status unlike in caste. These categorizations may reflect the attitudes of the people because it shows the importance people place on power and wealth in a society. In India the high castes are the Brahmins’. They inherit exclusive privileges from birth and are socially distinct while lower castes are deprived of their basic rights and are usually discriminated by the higher castes. In our present society we can see that people give more respect to those who are at a higher class than themselves; especially based on how much they earn. Social Inequality is seen in other areas of society too but it is more prevalent within the areas of race and ethnicity, sex and gender, and class and caste. Social inequality can only end if we become less ethnocentric towards those who are different from us and if we accept the social diversity in our world.

Behavioral Patterns and Projective Test

Personality depicts the unique thinking that defines the character of a certain individual. In order to understand the means of a certain individual’s personality, psychologists constructed a lot of different personality measurement. The most common measurement is done through the means of examination. Test or personality test is the most common conducted personality scale; this is where a certain individual is provided questions regarding his/her mood, personality itself, and other personal characteristics. One example of the measurements created by certain psychologist is the Big Five Personality Measurement. The structure of this personality measurement is said to be constructed on a hierarchical model of an individual’s personality traits. This measurement is structured with 5 and 10-itemed inventories which are to be evaluated. This is a short-time personality test and is used when there are situations which need a short-time-consuming personality measurement (Gosli ng, 2003). Another measurement is the Mood Survey which is the measurement used for measuring a certain individual’s sad and/or happy mood. This includes a questionnaire about mood, a personality scale instrument to determine whether sad or happy mood and the conducted mood surveys (Bill Underwood, 1980). The Mood survey is explained having two particular subscales namely the Level and Reactivity. These said factors or subscales are interrelated essentially that has an unchanging advantage on a certain state of mood scale. This is effective both in depicting a certain person’s personality characteristics and figuring out new idea about the origin and causes of mood and mood change (Bill Underwood, 1980).These two measurements are tested and were already used by psychologists in order to explain or define a certain individual’s personality so as to its origin, factors, and or reasons of change. Book report for the catcher in the rye Essay Example | Topics and Well Written Essays - 500 words

Book report for the catcher in the rye - Essay Example In many ways, the life of the main character, Holden, resembles that of Salinger. For example, just like Holden, Salinger had a difficult school life that was mainly characterized by poor performance. Also, Salinger lived a lonely quite life, which may be considered similar to that of Holden. The book criticizes the 1950’s culture through Holden. It highlights societal attitudes of ignorance to human conditions. It is the phony nature of Holden’s society that leads him to a nervous breakdown. At the beginning of the novel, Holden describes Pencey as phony. He sees most people surrounding him as phony. On his last evening at Pencey, he picks a fight with his roommate, Stradlater. He is offended by the idea that his roommate gets romantically involved with Jane Gallagher, one of Holden’s ex-girlfriends who he still admires. Holden feels that Stradlater is taking advantage of Jane, and picks a fight. The fight prompts him to leave Pencey immediately. He sets off by midnight and takes a train to New York City. On arrival, he checks into Edmond Hotel and spends two nights there. While there, he is mostly drunken and lonely. One of his most memorable experiences was with a prostitute whom he paid without getting her services. The prostitute turned out to b e unsatisfied and came back for more money. He later meets his Carl Luce, and old acquaintance and Sally Hayes, his on-and-off girlfriend. Both meetings leave him more lonely. He later sneaks into his parents’ house to visit Phoebe, his kid sister whom he’s more comfortable around. Talking to Phoebe brightens him up and he heads to visit Mr. Antolini, his ex-English teacher. He wakes up to find Mr. Antolini petting his head in a perverted way, which upsets him. His view of his society as phony heightens as he walks around his kid sister’s school and he keeps seeing swear words. He visions himself as the Catcher in the rye – the guardian of children.

Sexism in different cultures and societies Research Paper

Sexism in different cultures and societies - Research Paper Example The above statistics clearly show that sexism exists in many forms in America. In schools, teachers, give more attention to the boys than the girls. They believe that boys are brighter than girls and should get more attention. In professional world, women are getting lesser salaries than men even though both of them are doing the same job. Many organizations in America have the belief that men can handle certain jobs better than women. For example, in the recently concluded American Presidential election, Hillary Clinton fought hard against current President Obama for getting the Democratic Party nomination. However, majority of the Americans, voted in favor of Obama because of their perception that a male President could be more effective than a female President. If we take the number of women presidents or prime ministers in countries worldwide, we can see that the number of females is much lesser than the number of males. Even in America like advanced country, people believe that men have superior abilities in taking decisions and handling pressure and this belief is definitely the contribution of sexism. The number of females going to colleges is less than the number of boys when we consider the statistics of boys and girls who attend the college education in America after their school education. This is because of the parental belief that giving college education to the boys is more important than giving college education to girls. If an American family faces financial problems in giving education to their children., they will stop the education of their daughters first and will try maximum to give education to their sons. Majority of the men in America believe that the primary role of women is to do all the housework at home. Only after the completion of the house works, men like their wives going for other professional works. McFadden (2010) has pointed out that in American society, â€Å"Women are still being fired for getting pregnant and getting demo ted

(educatio)culture geography of childhood - Essay Example onal researchers have mentioned culture and tradition play a vital role in acquisition of values, knowledge, beliefs, behaviours and expectations of a child’s life. Eminent psychological and learning theories such as social constructivism and cognitive theory underlines the significance of social or family interaction in character formation and learning. By Barbara M. Newman, Philip R. Newman remark; â€Å"Vygotsky considered the nature of reasoning and problem solving as culturally created.† (Newman & Newman 2008, p.60). This photographic essay the researcher investigates the role of culture and tradition in a person’s character formation and learning. The selected photograph is about a boy named Aissa from an Algerian Islamic family. The photographic essay reveals a story or evokes a sequence of emotions in the mind of the reader which discuss cultural beliefs and traditions of a child. The first set of the photographs reveals that the boy Aissa is very frankly mingled with his family members and one can easily find his positive attitudes towards his parents. The boy keeps a healthy relationship with his family members. The given image (figure1and 2) also expresses the boy has developed good and excellent personality because he respects all members of his family and his society. Erich Fromm, Michael Maccoby assert;† Village parents are serious about obedience, and they feel that to be playful for or to show enthusiasm about the child at this age would undermine respect.† (Fromm & Maccoby 1996, p.189). The boy in this photograph is a member of a conservative Islamic Algerian family and this picture shows the cultural and religious background of the family. The given photographs help the viewer to reach the idea that the boy has followed and sustained a structured behaviour and it also reveals the characteristics of his culture and tradition which follow the habit of respecting others. Don Tinkler argues that â€Å"Of major importance in the development of

Recycling Literature review Example | Topics and Well Written Essays - 1250 words

Recycling - Literature review Example Although recycling markets differ in developed and developing countries due to technology, information, and market power, one thing is sure: Government intervention and citizen’s cooperation are proven necessary to make recycling successful. Today, recycling, specifically plastic bag recycling has continually gaining much support. Understanding Recycling Although oftentimes used interchangeably, recycling differs from reuse. Reuse does not involve remanufacturing; whereas recycling, Geiser (2001: 219) defined, is collecting used materials for reprocessing and remanufacturing. Materials are recycled either through primary or secondary recycling, depending on the quality of the product material. Materials minimally degraded go through primary recycling producing similar product – Used aluminium cans can be recycled to make new aluminium cans (Miller & Spoolman 2011: G13). Materials almost wasted go through secondary recycling producing different product of lower quality ( Geiser 2001: 219) – Used tires can be recycled into mats, shoes, safety surfaces, and many more (Saddleback 2009: 54). Recycling is an ancient practice and has continued ever since for almost the same reason – conservation. Though, conservation today is understood from a different framework. Before, people recycle mainly for personal economy (Geiser 2001: 217-218). Today, recycling is no longer a choice but a social responsibility for environmental reasons. The mounting solid waste around us threatens the earth’s life and human existence that recycling and tempering waste generation has to be taken is much needed (Purcell 1998, p. 190). The trend for recycling has started in the ‘70s with the greening of society and has been taken seriously in the ‘90s (D’Souza 2005: 2), seeing it more as an economic activity rather than a moral obligation (Walker & Desrochers 1999: 74) Truly, recycling today is making a big market worldwide, especially in dev eloped and developing countries, perhaps because incentives are given for recycling businesses, since their need for recycling is greater, as consumerism is high and wastes are mounting – Every year the UK alone dumps 24M tonnes of recyclable materials (Birmingham Post 2009: 10). Particularly in OECD countries, recycling has become an important economic sector with more or less 1.5 million workforces, a $160 billion turnover every year, and more than 500 million tonnes physical throughput. (OECD 2006: 16) While in the United States, various states provide financial incentives for recycling businesses to manage wastes profitably (Gordon 1993: 30). Factors differentiating markets for recyclable materials are identified: â€Å"information failures, technological expertise, and market power† (OECD 2006: 15). Recycling newspapers and water bottles is an old practice, but recycling other items like cellphones, batteries, light bulbs, and others is not yet commonly understood (Holmes 2010: 38). Even for used plastic bags, which though have an available market (Koontz 1996: 42), a better technology for its recycling has yet to be seen. Fortunately, the Institute for Mining and Minerals, University of Kentucky claims that waste plastics can be recycled into commercially usable oil in a quick, efficient, environmentally-friendly process. (Society for the Advancement of Education 1994: 12) Importance of Recycling The importance of recycling are identified and ranked as follows: (1) recycling of resources, (2) saving forest resources, (3) preservation of global

Literature review - Coursework Example The question thus remains whether financial sector can be considered as a signification source of economic development. In general, financial development has a twofold effect on economic growth. For one, capital accumulation can be increased by the financial sector. Secondly, development of financial institutions leads to enhanced savings which means greater investments resulting in greater capital accumulation. With increasing investments, capital can be used to increase the level of gross production. Also, properly developed financial institutions means increased variety of financial instruments that facilitate lenders and borrowers thus having a positive impact on the overall economy. However, in the long run other factors like human and physical capital need to be considered as other sources of economic growth. This paper will conduct a literature review on the subject of the relationship between financial development and economic growth in the context of the Indian economy. Furt her, the literature findings will be related with theories from articles based on similar context. Although not all views support the role of financial development on economic growth, positive views can be seen in Levine’s (1997) article. According to Levine’s theory, well developed financial institutions helps in reducing costs attached to information and transaction. Such reduced costs encourage increased investments leading to capital accumulation. With greater level of capital, there can be more spending on research sector leading to technological development causing higher efficiency in production process which in turns means increased level of gross production. Moreover, Levine has taken a broader approach in stating that various functions of financial institutions facilitate capital accumulation, rate of savings and trading of goods. Thus, he has concluded that financial structure as a whole,

Four questions to answer Essay Example | Topics and Well Written Essays - 4500 words

Four questions to answer - Essay Example This happens to describe the relation between the organisation and the employees. This is a key factor as it lets the employees know about the organisation’s policies and the transparency that it maintains in the internal as well as the external affairs of the organisation. This Professional area has some important elements embedded in it. Trade Unions, Health and Safety and Grievance and Disciplinary are a few to name. Let us now take a better look into all these elements individually and also integrating them so as to have a better understanding of the concept of Professional Areas. An associate member is expected to help improve and enhance the relationship between the employees and the organisation. Also one has to make sure, the execution of the policies and practices which necessarily cover the employee’s relationship with the organisation are carried out and this would also include industrial relations and those strategies associated with it. To maintain healthy relation between the organisation and the employees the Associate members should make sure that all the disputes are resolved at the earliest possibility. These disputes could be individual or collective. Ensuring the coverage of tribunals, grievance and disciplinary, employment law, contracts of employment and terms and conditions seconds none in the order of importance when the Employee relation with the organisation is concerned. They make up for a good relation by ensuring the employees rights and responsibilities. The resolving of issues though sounds like a normal job, demands plenty of diplomacy and spontaneity. The simple issues left unattended could turn into complex ones and they might be of great risk to the organisation. So the Associate member should resolve every issue, no matter what intensity it is of and should properly influence those leading the issue to the right approach. Among those critical jobs that the Associate members carry out, one that has to be definite ly discussed is checking the proper understanding of the organisation’s policies and procedures by the employees and making sure that they are integrated within the employees and are maintained in the workplace. On the other hand, the Associate members make certain it is just not the employees who need to have an understanding of the organisation’s policies and procedures, but also the HR Professionals who need to have an understanding of the full range of employee relations policies, practices and the employment laws. This is done to better manage the risk and the Associate member might also need to train them with individual coaching as per the requirements. They need to have a desire to learn as the job demands the necessity to learn about the continuously evolving employee relations both locally and globally. This is achieved by maintaining relationships with the counterparts, the formal bodies and communities of practice. This information gathered by the Associate member is then used to improve and make better changes in the employee relation plan. They also lead the negotiations between the trade unions, work councils and similar bodies regarding the labour issues and sometimes bring them to the notice of the higher authorities, depending on the intensity of the issue thereby creating an amicable working environment and building up a healthy relationship among them. U,S Economy Change Before and After WWII Ended Essay

U,S Economy Change Before and After WWII Ended - Essay Example Most of the sectors which oriented themselves to defense kind of production were like electronics and aerospace. Therefore, despite the fact that numerous Americans feared the return of the depression that had hit the nation before the war, after this war, they got quite a significant rise in personal income during the war that reached the year 1945. (Tassava, 2010) The two decades following WWII, are best described economically as ‘Growth period’. Despite the fear of most Americans that depression would haunt America again after WWII; up to 1970s, the economy experienced just mild recessions. An example to show this growth is that the period running from 1945-1960, the real GNP growth rate was (52%) fifty two percent. During the same period per capita GNP escalated by (19%) nineteen percent. Most notable after the WWII was the rise in production of consumer durable commodities. These commodities were like TVs, Cars as well as household appliances. The US’s service industries also expanded a great deal. (Walker, 1996 p

Assisted Suicide Essay Example for Free

Assisted Suicide Essay Have you ever heard a grown man cry; a cry so loud that you can hear and feel the pain within his voice? No, well it happens daily, here in the United States. There are thousands of people that are going through so much suffering that pain killers are like putting a band aid of a bullet wound. As hours pass the wound is getting bigger and the band aids are helping less and less. Most of these people just want a release, but even professionals cannot grant that request. Physician Assisted Suicide (PAS) is a controversial topic which is debated on through out the world. PAS) is a process where a doctor or nurse gives a lethal injection of medicine to a patient in need. But since this procedure is illegal, doctors are not allowed to aid an individual that is seeking a final release. This is the reason why terminally ill patients around the country are constantly tormented with pain and agony past their will. Assisted Suicide should be legalized in the United States because it will lead to less pain and suffering, less financial problems, and more time for the doctors and the patient’s family to get past this tragic event. The history of assisted suicide is neither lengthy nor complex. Aided suicide has origins tracing all the way back to around the fourth century, when scholars estimate the Hippocratic Oath, an ethical vow taken by doctors, was written (Liecht). Part of the Oath states, â€Å"I will not give a lethal drug to anyone if I am asked, nor will I advise such a plan† (Picket). What this statement is saying is that doctors are not legally or morally allowed to assist a terminally ill patient end his or her life. Within the last thirty years, however, instances of physician assisted suicide have been showing up all over the world. In 1997, Oregon created the â€Å"death with Dignity† law that â€Å"allows terminally ill patients to commit suicide with lethal doses of prescribed medication (Picket). â€Å"At least now theres a discussion around end-of-life care and what people want, and making sure they have access to hospice† (Dr. Hedberg). â€Å"People are talking to their physicians about being in pain. That dialogue has been improving in the state. I dont want to say that its because we have the law. However, over the past 10 years, it has opened people up to thinking about end-of-life care and palliative care as an important aspect of medical care† (Dr, Hedberg). So as years pass more and more terminally ill patients ask for the â€Å"end-of-life care† because of the pain and suffering they have to go through daily. Individuals that are at the end of their lives should have a voice to whether or not they should live painfully or die peacefully on their own terms. Everyday in the United States people decide to take their own lives so they do not have to go through sever problems health wise. For example, take the story of Edward Downes and his wife, Joan Downes was a successful maestro. He conducted the BBC Philharmonic and the Royal Opera when he was at his prime. In her prime, his wife had been a ballet dancer, as well as a choreographer. Recently, however, he had become nearly blind and his hearing was deteriorating very rapidly. Joan, his wife, had recently been diagnosed with cancer. Instead of living out the rest of their lives in pain and with the burden of the worsening medical conditions, the pair chose to use physician assisted suicide. The couple’s children were supportive and stated, â€Å"After 54 years together, our parents died peacefully and under circumstances of their own choosing† (Sciutto). Nine hundred and ? ty six usable responses relating to physician assisted suicide (PAS) and 957 in relation to family assisted suicide (FAS) were available. 84% of respondents supported legalization of (PAS) and 54% legalization of (FAS). This compares with 75% in favor of legalization of (PAS) in the US in 1994 and 73% in Australia in 1995 (O’Neil, Feenan, Hughes). These statistics are stating that the majority of the population that was given these questions believes that if assisted suicide were performed that they would want a professional performing this task. Conversely, there are many barriers in making decisions about death among family members, including culture, education, knowledge of the health care system, and the delegating of all decisions entirely to the family (Haley). A family member of a patient stated that all she wanted was â€Å"another sane adult’ who could â€Å"talk in terms†¦that removed the taboo from the processes by giving a real clear picture of possible approaches without advocating [PAS]† (Spigel). It is obvious that no relative would want to let a member of the family pass away without doing what ever is possible, so that the patient has every fighting chance to pull through. So the burden ways equally on the family, if not, more, because when it comes to assisted suicide grieving will last longer than pain every time. Once the procedure has taken place, the family members are the ones who have to take care of the patient after they are diseased. Along with pain and suffering, money is another aspect that needs to be taken into onsideration when the discussion of Physician Assisted Suicide comes up, in an unfortunate conversation. Every year more and more people are diagnosed with terminal illnesses, and the financial toll of the medical bills that are increasing rapidly and the burden falls mainly on the loved ones of the patient. These high medical costs must be borne by the patient, the patient’s family, or the society to prolong life. Thus, the decision to not prolong death could be beneficial to all parties involved (Chan and Lien). The longer the families hold off on their decision, the longer the hospital bill will be. Therefore the benefit of euthanasia is to avoid the realization of the negative cash flows (Chan and Lien). The older a person gets the easier it is to get seriously injured, so elderly people are more of a risk, and less of an award when they have to undergo medical procedures that might or might not save their lives. These trends will be cause for concern. Those elderly and infirm, who must rely on family and friends for care, feel particularly guilty about placing an extra financial burden on their loved ones (Odone). The elderly, as a group, have lower income and are more likely to suffer medical conditions that require a large sum of money to cure or manage (Chan and Lien). This fact alone displays the benefits of having Physician Assisted Suicide as an option that is available at all times. So if someone over the age of sixty gets hurt or injured within your family, most of those expenses are coming out of your pocket. Most of this care is still provided by relatives and friends, while state financed care is available only for those with low incomes. As a result, many pensioners are forced into selling their houses if they move into a nursing home, where the average cost is higher than what a majority of the people with medical problems have the ability to make. Some 2. 5 million elderly live below the poverty line (Odone). Denote Vt as the benefit of euthanasia at the time when terminal illness is diagnosed. Vt includes the cost of continued treatments avoided and the pain and suffering associated with the terminal illness that can also be avoided with euthanasia (Chan and Lien). The t in Vt represents time, so as t goes up the value of Vt goes down. The shorter time it takes an individual to react to the unforgiving reality of terminal illnesses, the better off the patient and the patient’s family will be. So if anyone is considering Physician Assisted Suicide, it would be more beneficial to them if they would go through with procedure sooner than later. The disadvantaged are also hit by today’s recession, when euthanasia may be seen as a cost-effective way to treat not only the terminally ill but all those who require extra care and assistance, including the elderly (Odone). Even though euthanasia is cheaper than keeping someone in the hospital, make sure that your situation is necessary for this process. So if euthanasia is available to you, do it for the right reason instead of thinking that is an easy way out. Consider the view point of a person that has a grandmother that was just diagnosed with a terminal illness. At first you will do what ever it takes to get your grandma back to tip top shape. But as time goes on, her situation is progressively getting worst and so are those bills that are stacking up on your kitchen counter. All of a sudden you have dug a hole so big finically that you can barely feed your family let alone yourself. So paving the way for the early and speedy exit of the elderly and the infirm can suddenly seem like a practical and inexpensive solution (Odone). Last but not least, the emotional aspect of assisted suicide is one of the most important contributions in the making of this decision. The emotions of the patient are the reason why the topic of Physician Assisted Suicide even comes up in a conversation. The mental mindset of the nurses and/or doctors is the reason why the procedure actually takes place. But the emotions of the patients’ loved ones will stay with them for as long as they will live. So the mindset of individuals called emotions are the reasons why (PAS) is needed and why it actually takes place. One doctor quoted a patient as saying, â€Å"I am going to come in and I am going to try to convince you. † Another doctor said, â€Å"I learned very quickly that the patient’s agenda is to get the medication. When I tried to talk them out of it, or to really assess their motivations, then they perceived me as obstructionist and became quite resentful of that (Stevens). The minds of the patients are made up. These unfortunate individuals are more concerned about relieving the pain and stress they have been going through, than to worry about the suggestions of others. If the patients don’t care about another person’s opinion on life decisions their life, then why should the government say that nobody can end their life early because of medical reasons? In a structured in-depth telephone interview survey of randomly selected United States oncologists who reported participating in euthanasia or (PAS), Emanuel reported 53% of hysicians received comfort from having helped a patient with euthanasia or (PAS), 24% regretted performing euthanasia or (PAS), and 16% of the physicians reported that the emotional burden of performing euthanasia or (PAS) adversely affected their medical practice (Stevens). An oncologist is a physician who specializes in the diagnosis and treatment of cancer. This observation of different doctors’ experience is stating that the majority of the doct ors feel better when they know that they helped a person in need. Dr. Linda Ganzini described the painful experience of two patients whom she [as the evaluating psychiatrist] disqualified for the option of Oregon’s assisted suicide law. She stated: â€Å"These disqualifications resulted in extraordinary pain and anger for both of the patients and their families, which interfered with much-needed opportunities to resolve other emotional issues (Stevens). † Although the mindset of a patient is not as clear as is would be if they were healthy, these individuals are still capably of thinking for themselves. But if the patient is not stable, the physician should consult with the family. But in this case, the doctor bypassed both the patient and the family’s choice when it came down to their daughters’ health. If both families agreed to have this procedure done on their loved one, then there should be not controversy with the decision by the doctor. Pain and anger is directed towards and felt by the evaluating psychiatrist. Such anger was energetically expressed by Kate Cheney, an Oregon PAS patient, whose evaluating psychiatrist told her, â€Å"You can’t make a decision for yourself and your life, because you are not in your right mind. † Kate Cheney’s angry response was â€Å"Get out of my house. I can’t believe you can tell me something like this (Stevens). † A psychiatrist is a doctor trained in the treatment of people with psychiatric disorders. This situation is another instant where the doctor denies a patient of Physician Assisted Suicide because the evaluating psychiatrist claims that the person in need is not mentally capable to determine if the illness is great enough to perform (PAS). The anger from Kate has carried on to her daughter. That shows that the patient, Kate, was mentally capable to express her anger enough that, the same emotion was cared on to another generation.

It is deemed to govern the product liability action that can be brought against a manufacturer or product seller, for causing harm by his product. It provides for a civil action being brought against the manufacturer or product seller for the loss or damage to a product itself or for commercial loss which will in turn be determined by the commercial or contract law which is applicable. It is designed to supersede any state law which is inconsistent regarding recovery in such actions. However this suppression is not applicable under a number of varied circumstances to include the defense of sovereign immunity asserted by any State or by the Federal Government of the United States. The Federal law except the Federal Employees Compensation Act and the Longshore and Harbor Workers Compensation Act, the Foreign Sovereign Immunities Act of 1976, the State choice-of-law rules, the right of courts to transfer the venue or apply it to a foreign nation or to dismiss a claim of any foreign nation or citizen on grounds which state that this is an inconvenient forum and also any statutory or common law cause of action including action to abate a nuisance, that authorizes a state or person to institute action for civil damages or civil penalties, clean up costs and so on. Any statutory or common law cause of action, including an action to abate a nuisance, that authorizes a State or person to institute an action for civil damages or civil penalties, clean up costs, injunctions, restitution, cost recovery, punitive damages, or any other form of relief from contamination or pollution of the environment or the threat of it. It also implies that this is a very important issue from the point of view of the hypothesis under consideration that US district courts will not have jurisdiction over any civil action under this Act based on the specified provisions of Federal law relating to district court jurisdiction. The Act also declares that in case of any provision of this Act shortening the period during which the producer of goods or his seller otherwise is exposed for liability, the claimant without cognizance of the period can bring about civil action under this Act within one year after its effective date. Title II of the Act allows any claimant to bring civil action for damages against a person for harm caused by a product applicable under the state law except to the extent such law is superseded by this title of the Act. Expeditious settlement measures include an option to include an offer of settlement for a specific dollar amount by the plaintiff or the defendant in a responsive pleading or award of attorney fees and costs to the party which does not accept the terms of settlement of the offer. It also caters for alternative dispute resolution provisions and mechanisms which are recognized by state laws. In Title III, a person is permitted to seek recovery for harm which has been caused by a product through civil action against the manufacturer or seller under applicable or Federal law to the extent that such law is superseded by the Act. It establishes a standard for liability by a product seller for the causes of the harm which can fall under categories of negligence or express warranty. The conduct of the seller can be examined with respect to a variety of factors such as construction, inspection or condition of the product and for not passing on the warning or instructions from the manufacturers only in case these have not been forwarded when the item was in his possession or has not made reasonable efforts to provide the users with the warning and instructions. The seller is treated as a manufacturer and is liable for damage caused in case the manufacturer is not effective to service of process in any State in which the action could have been brought which is relevant in the case of the hypothesis wherein the Federal laws are said to be applicable in states under the Act. Punitive damages are however proscribed against a manufacturer or seller of a drug or medical device where the drug or the device has received the pre market approval of the Food and Drug Administration (FDA); and the drug has been accepted as safe under conditions approved by the FDA. Similar protection is provided to manufacturer of aircraft which have been subject to pre-market certification by the Federal Aviation Administration (FAA). The factors to be considered in determining the amount of punitive damages have also been covered. Civil action is barred unless the case is filed within two years after the claimant is said to have discovered the harm and its cause and for a capital good which is not a toxic harm, the period is twenty five years after the delivery of product. The Act provides for compensation to individuals when their rights are infringed as there has to be provision for trans state movement of goods. As invariably there is transmigration of goods between states, there is a need for application of a federal law of such nature. The Bill was introduced by Sen. Robert W Kasten. Jr, a Republican on 13 March 1991 and had 39 co sponsors, which was numerically adequate to see the bill through in case a majority of the senators supported it. The proceeding of the Bill was as given below:-(a) The Bill was introduced on 13 March 1991 and then read and referred to the Committee on Commerce. (b) The Subcommittee on Consumer as well as the Committee on Commerce held hearings and it was reported on 14 November 1991 without amendment. (c) It was referred to the Committee on Judiciary by unanimous consent in June 1992. (d). After consideration by the Judicial Committee it was placed for consideration in Senate by Unanimous Consent on 8 September 1992. (e) Cloture motion to proceed was presented and withdrawn on 8 September 1992. (f) Cloture to proceed was not invoked in Senate by Yea-Nay votes on 10 September 1992 and again not invoked on reconsideration by Yea – Nay vote of 58 – 38. (g) There after this was not pursued further. However the Act in a modified form and through a separate motion has came into force in 1995. The issue before us is however that of liberals being federal focused vis a vis the conservatives. The bill was designed to regulate inter state commerce and provide a uniform product liability law as per the title. It was extensively for the benefit of the individual and the consumer and for all purposes should have been considered by the Senate and approved. However it appears that the underlying clauses in the Bill as given below which restricted the powers of the state could have contributed to its rejection for cloture:- (a) It declared that U. S. district courts did not have jurisdiction over any civil action under this Act, based on specified provisions of Federal law relating to district court jurisdiction. (b) Superseded any inconsistent State law regarding recovery in such actions. A quantitative analysis of the votes has been carried out in the Tables 4 to 6 given below. An examination of Table 4 will reveal that the overwhelming votes of Republicans, 40 have not been in favor of cloture of the legislation with only three for it. The liberal opinion has been with 18 not in favor of the cloture and 35 for it. This clearly indicates that the Republicans were not in favor of restricting the powers of the states even when these were in favor of the individual and also affected the regulation of commerce. This would have avoided a number of vexed issues arising out of inter state commerce which could have been smoothened. But the lack of cloture prevented from such a logical course taking place. The Republican bias towards state independence once again proved to be the stumbling block. An evaluation of the percentages polled will amplify this aspect further for which Table 5 may be examined. The Republicans have voted with an overwhelming 93. 1 percent against the cloture while 66. 1 percent of Democrats were in favor of the cloture. Thereby establishing that a majority of liberals do vote in favor of such motions which provide for federal control on issues which impinge on state – federal relationship. In case the voting is examined quantitatively in terms of percentage of voting in terms of Ayes and Nays with party affiliation, it would emerge that 68. 9 percent Republicans and 31. 1 percent Democrats had voted against the cloture and only 7. 9 percent Republicans and 62. 1 percent Democrats were for cloture. Thus the Democrats are deemed to be overwhelmingly in favor of the cloture.

Thermal Solutions to Reduce Electricity Costs

Thermal Solutions to Reduce Electricity Costs Executive summary This report investigates and analyses the thermal solutions to reduce the electricity cost for senior school at St Aidan’s Anglican Girls’ School. Approaches of analysis include calculating energy loss, thermal current and comparing current costs and revised costs, as well as the long-term (each term and annual) prediction for power consumption. The annual electricity cost is predicted to be $23064.56. All calculations can be found in the Appendix. Results from calculated data show that 29.09% of the power consumption can be reduced by replacing 36 W lights from 18 W tube light bulbs ($4.90 for two tubes, $44.10 overall) and installing the Hampton thermal curtains ($276 in total) with pelmet boxes ($183) of five years life expectancy. Hence, they are suggested to renovate every five years to maintain the efficiency of thermal curtains. Although these installations will need $503.10 initially, the payback will begin from the 7th month. This report evaluates that the current setting of the classroom in senior school can be altered to protect the environment and minimise electricity costs. Therefore, there are some recommendations: Install the Hampton thermal curtains with pelmet boxes Thermal curtains should be shut all the time in order to achieve the revised cost Small technology devices (e.g. projector, printer, iron and hot glue guns) usage should be minimised to reduce power usage (e.g. turn them off instead of stand-by when not using) There are some weaknesses of the report: Thermal current of furniture in the room is not considered. Monthly temperature data are not exact results, they are based on past average temperature data. Number of classrooms are an approximation instead of counting due to variation in classroom setting (e.g. one air-conditioner, more or less lights, fridge) Key assumptions The power is assumed to be used only on schooldays. The energy loss from the recorded data (the energy required to cool down) is assumed to be the same every day. The room is assumed to be a closed system, so the thermal current of windows is equivalent to the power usage of both air-conditionings. Power Usage Analysis Introduction Thermal (heat) energy always tends to transfer from one hot space spreading to colder surroundings space by conduction, convection and radiation (Cambridge University Press, 2014) and its flow is affected by the temperature difference. Thermal current () is the rate at which heat energy passes through a material, which is calculated as . The thermal conductivity (k) is a measure of how well the material transfers heat; lower values of conductivity indicate better insulating material. Thermal insulators such as thermal curtains and double glazing windows are commonly used in homes or buildings to maintain constant room temperature by prevention of convection current and minimise energy usage. This report will investigate, analyse and recommend thermal solutions for the school to reduce electricity usage and environmental benefits. Investigation and discussion Note: All data refers to Appendix – Calculation The data was collected by using Sparkvue temperature sensors connected to a computer. The first 30 minutes of the data was disregarded due to the sensor being exposed to direct sunlight, leading to the extremely high temperature (especially the peak at 3:19pm at 47.4Â °C) at the beginning of the data (Graph 1). Through analysis and calculations of the data, the internal temperature change had a positive gradient (between 5:04pm and 6:04pm) which indicated the room was gaining energy as the air-conditioning turned off (347.08 W). Current power usage During schooldays, 18 lights were used 1 hour 43 minutes per day and two air-conditionings were used 10 hours daily on average. The lights were found to consume a relatively low amount of energy of 1.11 kWh daily. Since the room was assumed to be a closed system, theoretically, the thermal current of the windows (137.14 kWh) should be equivalent to the power usage of air-conditioners. However, due to the information written on the air-conditioning was its upper most power usage, they would not be equal. In fact, the calculated consumption (Table 2) was less than the given data, which indicated the difference in power usage could be attributed to dissipation through the walls, floors and doors openings. Moreover, the total consumption (139.52 kWh) included the power consumption of lights and technology devices in the room to achieve higher accuracy. Thermal solutions Thermal solutions are reasonable and beneficial to diminish power consumption. The 36 W light bulbs can be replaced by 18 W lights, which each consume 0.56 kWh daily. Furthermore, thermal curtains are the most common thermal products, because more internal thermal convection current will be blocked, especially when the curtains are extended so that it reaches the floor. This would prevent the convection current and reduce energy flow into the room (Figure 9). Double and triple glazing of windows are commonly used as well, due to vacuum between glass panes eliminating losses by conduction and convection; however, installation is expensive, so thermal curtains are the most economic thermodynamic barriers to use in order to reduce the energy usage. Figure 9 – No gap (Rogers A, 2011) From researching thermal curtains, the Hampton thermal curtain is thermal coated which reduces a maximum of 25% energy loss (Energy.GOV, 2012). Only the front windows have contact with direct sunlight; others are all under shelter, so thermal curtains will only cover these. Hence, the Hampton thermal curtain is suggested to be installed for energy reduction, costing $276 in total. Pelmet boxes cost $183 overall, because the side of the front windows have a length of 6.02 m each, it would be reasonable to get two 6.10 m pelmet box on each side(some space for the curtain rod). The life expectancy of thermal curtains is usually five years; it is reasonable for the school to renovate new curtains every five years. It can be seen from Graph 2 that the costs maintain the same and increases by another full cost of $503.1 after renovating at the end of each five year cycle. Furthermore, the power usage with thermal solutions is calculated to be 97.25 kWh, having a 29.09% difference compared with the current settings. CBA – Cost Benefit Analysis The CBA graph (Graph 3) shows the current cost model and revised cost model accumulating over time. The break-even point occurs in the 7th month and when the current cost is approximately equivalent to the revised cost at $1661.8 and $1654.3, the current cost will exceed the revised cost. According to the CPI in Queensland has been fluctuating from 2007 to 2012 (Figure 10), which may continue changing in the next few years. By considering a long-term situation, Graph 4 illustrates an example of revised cost will increase every five years due to renovation of curtains, whilst maintaining a smaller rate of power consumption than the current cost. The power consumption for each term is calculated (Table 3-6) and used to investigate the annual revised cost of $23064.56 and 28.98% of electricity cost will be reduced from current cost in the senior school. If the electricity price increases 5% for both peak and off-peak hours, the trend would stay the same as the current cost has a higher gradient than the revised cost (Graph 4) and the fluctuation has an impact on the overall costs. (Australian Government, 2015) Figure 10 – CPI Annual Change Brisbane Recommendations The ultimate goal of diminishing the energy usage is to protect our environment and minimise energy consumption. Therefore: Thermal curtains with pelmet boxes and light bulbs should be installed. Curtains should be shut all the time in order to achieve the revised cost. It would be the most economical way if all small technology devices are not used at all (e.g. projector, printer, iron and hot glue guns). In conclusion, after installing the thermal solutions it is predicted to spend $23064.56 annually in the senior school, and results in saving approximately $13072 on power usage when all assumptions are valid, which will therefore reduce environment impact.

Essay on The Awakening as Romantic, Realistic, and Local Color Writing

The Awakening as an Example of   Romantic, Realistic, and Local Color Writing A fair woman slowly, but surely, makes her way into the water.   It is obvious that she is slightly afraid, but not to the point where she is willing to stop progressing into the gradually deepening water.   She believes that after she lets the water grab her life, everything will be fine.   Sounds appealing?   I did not think so.   However, Edna Pontellier thinks that this is the best option for her.   Drowning seems to be the only way out.   The Awakening, by Kate Chopin, describes Edna Pontellier's battle against society, and how she decides to handle this battle.   This novel was considered an immoral piece of literature during the early 1900's.   Its descriptions of a strong woman who goes against a grim and strict Creole society shocked critics and readers alike.   Edna's strong will and determination cause changes that were not welcome at the time.   Despite the fact that The Awakening was unwelcome in the early 1900's, it is a widely read novel that most consider to be an extraordinary piece of literature.   The Awakening is a great novel because of its unique combination of Romantic, Realistic, and local color writing.      Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The Awakening demonstrates Romanticism in many ways.   The accentuation of the imagination, freedom, emotion, nature, and nobility of the common man characterize Romanticism.   The Awakening demonstrates this in many ways.   For example, a mockingbird and a parrot are shown to describe the role of women of that time; they had the potential to be successful and respectful citizens, but society kept them caged in.   This demonstrates the "natural world" aspect of Romanticism.   In addition to this, constant references are ma... ...nd city names in her writing adds a lot to the feeling behind the novel.   Using the name "Grand Isle" has a larger effect on the reader than if she were to say "beach", or even "summer getaway".   Through the utilization of local color, the reader actually feels that he or she is a part of the novel, walking alongside the characters and feeling all their pain and suffering.   He or she can form visual images of life during the time of the Creoles.      Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Through her inclusion of Romantic, Realistic, and local color writing, Kate Chopin makes The Awakening a truly extraordinary piece of literature.   Reading this novel makes the reader feel that he or she is living during the society of that time.   This is a unique writing that demonstrates one-of-a-kind combinations of literary elements.   Every person should read this novel and appreciate it for the talent.

Washington D.C: Our Nation’s Capital :: History

Washington D.C: Our Nation’s Capital Although the entire world is familiar with the City of Washington as the United State’s capital, the city was nonexistent when we became a nation in 1789. Thanks to the brilliant design of the French born engineer, Pierre Charles L’Enfant and his assistants Benjamin Banneker and Andrew Ellicot, our capital city that was once a swamp now is beautiful with many different parks, gardens trees, tall buildings and wide avenues. Washington, District of Columbia named after Christopher Columbus, has played a unique role in the wars of our nation and has been dramatically affected by their awesome events. The battles, conflicts and politics of war have forever changed America. During the War of 1812, the British burned the newly-built capital; The Civil War transformed Washington District of Columbia (DC) from a sleepy Southern village into the powerful capital of a reunited nation. Through the course of World War II Washington became the nerve center of an unprecedented war effort and headquarters of the postwar free world. During and after the Civil War, thousands of slaves fled to Washington D.C., thinking that if they reached the capital, they would be safe and free. However, the government was totally unprepared for an influx of this magnitude. There was no place for them to live, very little food, and no employment. Sojourner Truth was a very inspirational woman who was a former slave that worked with th ese people trying to improve their living conditions and was later employed by the government’s Freedmen’s Bureau. Wonderful black people like Sojourner Truth and James Wormley who was a successful hotel owner, were a very essential component to black’s rise in DC. They gave hope to hopeless black people. Their lives demonstrated that black people could rise above the turmoil and uproar. Before our nation’s capital rested as Washington D.C it was located in New York City temporarily. A year later it was moved to Philadelphia, Pennsylvania. A fierce rivalry developed between the northern and southern states over the location; their economic interests were completely different. The states believed that the newly appointed city to be the nations capital would have more power over the remaining states, even congressmen were aware that the area receiving the capital would gain wealth and political influence. Some of the competing cities offered land and money as incentives. This discrepancy that was finally resolved by a political compromise.

Comparing Synge’s Riders to the Sea and Beckett’s Endgame :: Comparison Compare Contrast Essays

Synge’s Riders to the Sea and Beckett’s Endgame 1 1 Introduction Riders to the Sea by John Millington Synge (1904) and Endgame by Samuel Beckett (1958) show many similarities despite the eventful half a century that passed between their years of publication. The similar elements (the setting, the relation of the characters to the outside world, etc., related in detail in the next section) seem to create an atmosphere in both works that is fit for the creation of a new mythology. However, by separating the physically present elements from those which are conjured up only by words in the texts (determining the A/B structure of the works), one of the—probably—most important differences can be discovered between the two plays: namely, that while in Riders to the Sea, a new myth is actually being created, this act of creation is missing from Endgame—possibly because newly created myths (and values) are deemed impossible by Beckett in the light of the two World Wars of the 20th century. During the course of the essay, it will also be suggested that this creation is, in fact, what characters (more specifically, Maurya, Hamm and Clov) are all waiting for; and that while the world-view of Synge’s play reflects, to a certain extent, the views of objective idealism, Beckett not only lowers the level of idealism to the subjective level, denying the existence of a rational, global control, but also goes further to deny the existence of any ord ering power in the world at all. 1 2 â€Å"Outside of here it’s death† (Beckett 2:2475). Environments Fit for Myths It has been suggested many times (for example, Tokarev 1:12), that mythology was the main instrument for the so-called ‘primitive’ cultures to understand the surrounding world. If this is so, then the world, in a pre-mythic or mythless state, must present itself as dangerous and inconceivable, as it actually does in both plays. In both works, the setting is a room: â€Å"Bare interior† (2:2472) in Endgame, and a â€Å"cottage kitchen† (83) in Riders to the Sea, outside which room, in both cases, lies the realm of (literal) death. In Endgame, this is expressed directly, as Hamm declares often: â€Å"Outside of here it’s death† (2:2475) and â€Å"Beyond is the†¦ other hell† (2:2481), when feeling the wall that separates the two spaces.

Christine Adika

Directed by Roman Polanski, The Pianist is an outstanding, emotion-filled film which brings us back to history when the German Nazi invaded Poland. Basically, the film is all about the struggles experienced by a Holocaust survivor in Nazi-occupied Warsaw in Poland. The Pianist is based on the life story of a Holocaust survivor Wladyslaw Szpilman, played by Adrien Brody, who is also a talented Jew musician who belongs to the well-off family in Poland. The Pianist is an interweaved story of survival and complexity. The film also starred Emilia Fox, Michael Zebrowski, Frank Finley, and Maureen Lipman. The film started with Szpilman passionately playing his piano over a live radio recital—just while the German Nazis has invaded them; just when bombs are exploding and people are dying in the area. The Szpilman belongs to a family who lived a comfortable and well-off life not until September 1, 1939—when the German Nazi started invading Poland. The Jews of Warsaw was brought in a ghetto, including the family of Szpilman. While his family was brought to a death camp, Szpilman escaped and survived the brutality. He hid in an abandoned building. As he stayed there, a German officer who shares the same interest as his in music became his friend. The German officer became the one who gave him food regularly.   He lived underground until the Soviets arrived. Some say that Adrien Brody did not act well in the movie. They say that the actor did not display any kind of emotion that touched them. But I think Brody is portrayed his role well. Although, given with a relatively few lines in the film, managed to capture the emotions of  the viewers, I think. He exactly depicted the role as I imagined it as read the book. It was no doubt he won the Oscar Best Actor award. The music of the movie, which appeared to be perfectly chosen, enhanced the setting and the mood of The Pianist. One example is the Chopin, which he played during his live recital over the radio while bombs are exploding outside.   Chopin represented his passion for music. Meanwhile, the Nocturne in C-sharp Minor setting emphasized that the film is an historical account and. Its tone set the stage for the dramatic tone of the movie.   The â€Å"Moving to the Ghetto† song also enhanced the film. The Pianist was based on a book written by Szpilman right after he was rescued by the Soviets which was originally titled as Death of a City. It served as a diary of a Holocaust survivor in his days in hell. The film director was successful in bringing in to the viewers of the film the exact setting in the book. The film, through its cinematography showed the viewers the pain that the Jews had to endure. The plot of the film showed scenes as traumatic as the book had traumatic story in every page. The book was perfectly represented in the film especially the part that the Jews are treated as â€Å"parasites of the humanity.† Just how the book described the cruelty of the German Nazi, the movie flashed scenes which are, I must say, equally brutal as told in the book. The main character was also portrayed as how Szpilman appeared to be in the book. Watching the film is actually reading the exact book. It was like turning each page of the book as I witnessed each scene in the film. The film basically revolved around oppression that happened during the German Nazi invasion. I think tried to show the pains and the sufferings that one has to endure for him/her to liberate him/her fully from the oppressors. The film featured no heroic acts or anything that are usual in the protagonists of a film. It mainly told us a story of survival—even when almost alone. One worth noting in the film is the occasional use of metaphors and symbols to creatively present the message or the content of the film. One example is when he looked intently to his piano. The musical instrument that he once used to entertain and â€Å"allure† other people is now an instrument could signal death. The Pianist is definitely a must-see movie. The film is imbued with artistic substance while portraying one of the most brutal plights in history. The movie disdains Spielberg’s â€Å"Schindler's List† which provided a larger picture of a Holocaust and opted to focus on one individual who had experienced to be in the same situation. This choice made the movie more effective, I guess. Because I was able to understand feel more the situation during that time. The Pianist provided a magnified view of the Holocaust—and that made the movie more interesting. Focusing on one individual, I think, made the audience feel more the mood and content of the movie. More than a mere autobiography and an historical account, The Pianist is a magnificent work made by a cinematic mind. The two and a half hour viewing of the film might cause you to hold your breath due to the chaotic story with a brilliant portrayal. To say that the film is just an ordinary one and lacks twist and creativity is like saying that you don not understand the movie at all. The movie has a string of profundity that must be dug in for the viewer to comprehend and absorb the essence of the film. The movie is not all about winning and losing, hiding and seeking. Simply put, it is all about life death. Survival, that is. Reference: Internet Movie Data Base â€Å"External Reviews for The Pianist† 31 March 2007

Baroque Art and Music

Both Baroque art and music evoke strong emotions in the people they are intended to touch. The subjects, while not inevitably overtly religious, primarily deal with religious subject matter. Many of the paintings of this era brought religious figures into what were then familiar settings, such as placing a Madonna figure into a crumbling Roman city street. Others, however, used the dramatic effects of chiaroscuro shading and broadly painted gestures and expressions to create images that have transfixed viewers for centuries. So, too, have the strains set down by Baroque composers held the imaginations of listeners over the centuries. Few people, even those who claim to be unfamiliar with â€Å"classical† music would fail to recognize the â€Å"Hallelujah Chorus† from Handel’s Messiah or the lilting notes of Vivaldi’s â€Å"Spring Concerto† from the Four Seasons, even if they could not name the pieces. This paper will be used to briefly discuss and co mpare some of the dramatic effects used in Baroque art and in Baroque music. Baroque ArtThe art of the Baroque period was naturalistic; that is, the people portrayed in the paintings and statuary were sometimes portrayed with human flaws. But it was also at this time that light and shading was used to create the focus of the piece by casting many of the supporting figures into relative darkness and bathing the primary figure in light. This effect, chiaroscuro shading, was perfected by Caravaggio and was often adopted by other Baroque artists, as well as other, later artists (author, date, p. 162).This kind of art was not used to focus only on beautiful or noble images; Artemisia Gentileschi depicts the Old Testament story of Judith and Holofernes in all of its brutality using chiaroscuro shading to horrific effect (author, date, p. 164). All the same, dramatic shading was not the only artistic development of the Baroque period; art during this period took on a never before seen sens uality, even in artwork with a religious theme (author, date, p. 165). Baroque Music Like Baroque art, Baroque music was both dramatic and groundbreaking. However, unlike Baroque art that was growing more complex, the music of that period was becoming simplified and giving its religious themes a â€Å"wider and more universal appeal† (author, date, p. 183). Stories from the Bible were performed in a vocal style known as the â€Å"oratorio,† (author, date, p. 185), of which Handel’s famous Messiah is one. Although Johann Sebastian Bach is perhaps more famous for his development of the complex musical fugue, he also composed vocal scores using the chorale prelude and the cantata to bring the Gospels to life in a musical form (author, date).Musical innovation was not confined to religious themes, however. The opera was born in during the Baroque period, drawing largely on Greek tragedies set to new music, since the original Greek music had been lost. Monteverdi was an innovator in this new musical art form, fully exploring the musical form of â€Å"monody† or â€Å"recitative. † Monody was, and is, an extended vocal line supported by instrumentation (author, date, p. 184). Antonio Vivaldi used a similar theme in his music, creating a single and elaborate musical line that extended itself â€Å"luxuriously† through a given piece (author, date, p.187). While Baroque art was often heavy, the music composed by Vivaldi and others like him was often light, carried by string instruments. Conclusion Both art and music experienced transformative innovations during the Baroque period. Although religious themes continued to take the central focus, artistic forms became more accessible to more people during this time. The Baroque period brought music and artistic forms into the world that are still popular today.

Analysis on Ernie Pyle’s on World War II Essay

In Ernie Pyle’s â€Å"On World War II†, he made a few statements. His statements are immediately about World War II, yet they can be applied to nearly every other war. Edward Pyle embedded his messages into the reading through the clever usage of rhetorical devices and figurative language. Of the few messages that Edward Pyle made, one of them is more prominent than the other. â€Å"Anything and everything is expendable.† Pyle was implying that in war, a man’s life is unfortunately no more important than the equipment he uses. This can be implied to almost any war that has happened before. The men and their equipment can be replaced almost instantly. The other message embedded within Pyle’s story is almost the opposite of the previous one. â€Å"There were the latest letters from home, with the address on each one neatly razored out-one of the security precautions enforced before the boys embarked.† Here, Pyle was talking about the importance of the otherwise â€Å"expendable† men. They are not just some replaceable toy soldiers to test out some new strategies. They have families and friends off of the battlefield. They might be only one person in the world, but they can be the world to one person; which means they are irreplaceable and undependable. Ernie Pyle uses rhetorical devices such as description to transfer his messages to the reader. His messages are about the individuals in the war, but can be implied to every large scale war. The main messages are opposites of each other; one is of the individual’s importance and the other of their unimportance.

Coso Risk Management Plan

COSO Risk Management Plan LAW/531 BUSINESS LAW March 18, 2013 Nicole Harrison COSO Learning Activity Beasley, Hancock and Branson (2009) have mentioned that â€Å"Many senior executives and their organization’s board of directors are working to strengthen risk oversight so that they are better informed about emerging risk exposures, particularly those impacting strategy† (p. 01). This statement clarifies that companies are looking for better ways to manage risk and they are using techniques to help achieving this goal. The Committee of Sponsoring Organizations of the Treadway Commission (COSO) is an organization leading the way on providing frameworks and guidance on enterprise risk management, internal control and fraud deterrence designed to improve organizational performance and governance and to reduce the extent of fraud (COSO, 2013). It is a joint initiative of five private sector organizations including the American Accounting Association, the American Institute o f CPAs, the Financial Executives International, the Association of Accountants and Financial Professionals in Business and the Institute of Internal Auditors. This paper has the objective of identify recommendations about how it would be useful for an organization to adopt COSO as the structure for its own corporate compliance plan. According to Steinberg (2011) â€Å"In recent years, to complement the use of key performance indicators, which focus primarily on past performance, more organizations have adopted forward-looking key risk indicators to further enhance risk management effectiveness† (p. 01). Corporations monitor their performance based on indicators (KPIs) that provide a trend from a time in the past to date. This performance trend can be compared to others, such as competitors and general industry performance to assume how the business is moving ahead. But that is not enough. Risk-management specialists and organizations like COSO suggest that corporations start lo oking at Key Risk Indicators (KRIs). Those indicators are looking to the future of the business and its industry and enable management to deal with risk events more quickly (Steinberg, 2011). The KRIs can be part of the strategic plan of a corporation and help to create a more precise SWOT analysis by using real ratios instead of mere market assumptions.Beasley, Hancock and Branson (2009) say that â€Å"Risk management and strategy-setting activities are often viewed as separate and distinct, with risk management sometimes stigmatized as being a non-value adding, compliance, or regulatory function with no visible or clearly articulated connection to the organization’s strategy† (p 13). Corporations should review this outdated concept and start using the power of risk management as an essential element of their strategy.COSO presents their own definition of Enterprise Risk Management (ERM) and summarizes important elements to a successful implementation. The organizatio n defines ERM on Beasley, Hancock and Branson’s article (2009) as â€Å"A process, effected by the entity’s board of directors, management, and other personnel, applied in strategy setting and across the enterprise, designed to identify potential events that may affect the entity, and manage risk to be within the risk appetite, to provide reasonable assurance regarding the achievement of objectives† (p. 4). COSO is great source of knowledge and experience for all sizes of companies. A financial crisis, a simple change in the market, the complexity of business transactions, advances in technology, globalization, and the speed of product cycles can be fatal for any business and, in order to avoid that, managers, executives, and boards should strength risk management in their organizations. An Employee Or Independent Contractor

2. If we assume Simone is an employee, is PR PRO in breach of a common law duty in relation to not giving Simone any days off work or holidays? 3. If we assume Simone is an employee, does she have an entitlement to notice, at common law or pursuant to legislation, if PR PRO decides to replace her? Common law introduced number of tests to identify the status of individual in organization: First test applicable by the Court’s are â€Å"Control Test†. This test is determined by Court in case law Zuljs v Wirth Bros Pty Ltd[1]. In this case, Court held whether employer has right to exercise control over employee is considered as important element as compared to actual control exercised by employer. This element is the strong evidence of employer and employee relationship. It must be noted that control test and integration test are not the strong evidence on which Court takes their decision. In other words they are not considered stand alone test by Courts. There is one more test that is multiple indicia test, and this test was established in Steven’s v Brodribb Sawmilling Co Pty Ltd[2]. In this case, the main issue is whether Gray and Steven’s are employees or independent contractors. Court applied multiple indicia test for determining the employment status of Gray and Steven’s and stated that Steven’s was an independent contractor. However, Court also stated further developments regarding this test are completely based on the interpretation of future judges[3]. Later this test is confirmed in case Hollis v Vabu Pty Limited[4]. In this case Court held that bicycle couriers are not working as independent contractor but they are considered as employee of Vabu Pty Ltd. Therefore, Vabu Pty Ltd is vicariously liable for the act of its employee who never identified on personal basis by individuals because he wears uniform of Vabu[5]. High Court of Australia stated that now a day control cannot be considered as only factor to determine the status of individual in the company. Multiple indicia test includes: Employee relationship is stated if worker integrated into the business of employer such as wearing uniforms, signage on vehicles, etc. Employee relationship is stated if worker is entitled to entitlement and allowances such as Leave, superannuation, workers compensation. A worker is considered as independent contractor if he arranges the taxation matter at his own. A worker is considered as independent contractor if that person is tradesperson or professionals and conducting their own business. A worker is considered as independent contractor if he was engaged to perform some particular task, and worker is considered as employee if he was employed for some definite period. If remuneration is provided in wages then person is considered as employee, and if remuneration is in the form of lump sum, price per volume or as per results then worker is considered as independent contractor. If worker sets his own place and hours of work then he is considered as independent contractor. If worker have ability to delegate his work then he is considered as independent contractor. If employer has control over the conduct of worker then he is considered as employee of the company, and if employer has control over the reporting then worker considered as independent contractor[6][7]. In the present case, Simone working in PR PRO, and she entered into an agreement with PR PRO at the end of 2012, to operate from 1 January 2013 until 31 December 2016. This agreement stated that Simone was not an employee of the company but she is abiding by all the rules of the company. Simone wears the shirt which had logo of PR PRO and she received agreed percentage of sales she made but she also receive small amount of base payment on a monthly basis. She paid income tax directly to the taxation department. Working hours of Simone are not set and she uses her own car for meeting the clients but she gets no allowance for that. She gets training from specialized agency and PR Pro pays for it. It is necessary for Simone to keep her phone all the time so she can answer her clients, and she receives extra payment where work took weekend and public holiday hours. Simone never gets any entitlement related to personal leave or holiday leave and company has never offered her any paid holidays. In this case all multiple indicia test is applied which discover following factors: After considering all the above factors it is clear that she work as an independent contractor in PR PRO. Annual leave is also known as holiday pay in Australia which means employee must be paid while having time off from work. Annual leaves entitlement introduced by National Employment Standards (NES). Any time of award or agreement cannot provide annual leaves less than those stated by NES but they have right to give more annual leaves. Annual leaves become part of NES standards 1 January 2010 and standards of NES apply to all employees covered by the national workplace relations system. All employees except casual employees have right to get paid annual leaves[8]. An English case law Morley v Heritage plc [1993] IRLR 400. In this case, there is general rule which stated that every employee was entitled to annual leave for the period of four months per year. Full time and part time employees of the company have right to get 4 weeks of annual leave, and these leaves are based on their ordinary hours of work. Employer cannot breach standard of NES and in case of breach of NES standards court imposed penalty of $10,800 for an individual and $54,000 for a company[9]. Annual leaves accumulate from the day of joining of employee, even though probation period of employee is not over. Accumulation of annual leave is done when employee is on: Accumulation of annual leave is not done when employee is on: In the present case, on 1/12/2016 Simone had a stroke because of which she lost her capability to work in the foreseeable future, and doctor stated that reason of stroke was high stress level, and her obesity. The reason behind this is that she had no holidays or weekends free from work for a long time. Simone has right to get 4 week annual leave as an employee of the company and company breach their duty under common law by not providing annual leave to Simone. Therefore, PR PRO breach their and court can impose penalty of $54,000 for breach of NES standards. In this case, PR PRO breaches their duty under common law by breaching the standards of NES for annual leave. Employee has right to receive notice from employer, and employer cannot terminate the employment unless he gives written notice to the employee. It is necessary that employer must issue notice to the employee personally, send the notice at last updated address, and sending notice to employee by pre paid post[11].   Minimum time period for serving notice to the employee: An employer’s cannot terminate their employees unless they give minimum period of notice or make complete payment of employees they have worked. Total employment period of employee Employment period of employee is not more than 1 year Employment period of employee is more than 1 year but less than 3 years Employment period of employee is more than 3 year but less than 5 years Employment period of employee is more than 5 year Every employee of the company is entitled to receive minimum period of notice or payment under FW act, and the period of notice is depend on the length of service of employee. It is the duty of employer to ensure that whether employee is entitled for higher period of notice[13]. This can be understand with the case law that is Lavarack v Woods of Colchester [1967] 1 QB 278 ('Lavarack'). In this case, Court sets out the general principle that in case of termination, employee has right to claim for what he is legally entitled. In the present case, PR PRO decided to replace Simone because of her disability to work in near future. In this case, Simone is working in the company from last 4 years and as per the requirement of FW Act PR PRO is under obligation to serve minimum notice period to Simone. As per the requirement to serve minimum notice period the length of service of employee is considered. Simone is working from last four years in the company and she is entitled to receive notice for the minimum period of three weeks. PR PRO is under obligation serve 3 weeks’ notice period to Simone under FW Act. Zuljs v Wirth Bros Pty Ltd (1955) 83 CLR 561. Stevens v Brodribb Sawmilling Company Pty Ltd (1986) 160 CLR 16. Business Employment Law Essay Example | Topics and Well Written Essays - 2000 words

Business Employment Law - Essay Example As it appears, all other employees apart from Mark agreed to work overtime. In his submission, Mark indicated that he was not under any contractual obligation to work overtime. This infuriated Rebecca who decided to take the matter to the manager. However, it is also indicated that there was always bad blood between the two employees, and this seemed to be an opportunity to settle the scores. The dismissal of mark from the work is unacceptable and therefore he has the right of appeal. While the law provides the employers with the prerogative to dismiss employees for gross misconduct and without warning, the case of Mark is different. Firstly, the company should have let the employees know of the staff shortage. Secondly, such employees ought to have been requested to offer themselves for overtime work to compensate for losses incurred due to such shortage of employees. As it stands, the request to have Mark work beyond his normal hours appears to be an ambush. In addition to that, th e manner in which the information was passed to him is also wanting. It is vital to note that employees just like employers, have their personal rights1. On that material day for instance, Mark had an appointment with his girlfriend. He made such arrangement because he had not been informed of any changes by his boss. Therefore, it seems that the company suffers from lack of good communication and relationship with the employees. Thirdly, the dismissal is unjustified based on the fact that when Mark was employed, he signed a contract that indicated the time that he was to be in the job. His decision however mean it may seem to be was justified. There was no prior complaint that he failed to provide quality work because of incompetent or any other factor. It therefore seems that he was a dedicated person who understood his rights well. It seems that the management failed to conduct its independent investigations to ascertain the allegations2. Relying on the information provided to th em by a fellow employee was wrong since there could have been other reasons which could have prompted Mark to take the decision he did. Even if this was a gross misconduct according to the management, law requires that investigation is carried out. For instance, it is indicated that Rebecca and Mark had a malfunctioned relationship which affected their communication. It is therefore possible that this was a malicious act meant to punish Mark by dismissing him. She may have passed communication to other employees about the overtime work and failed to let Mark know in advance. The management therefore was in contravention of the statutes guiding dismissal. There are various unfair grounds through which one may be dismissed. They include lack of good reason, being asked for flexible hours and also if one refuse to work overtime. From the case, it is outright that the firm did not have objective grounds to dismiss Mark. He was dismissed immediately even though he was innocent. He had a right to choose either to work or not. Employees have their flexible time which they may choose to offer or not. Depending on prior communication with the company, employees may choose to comply or refuse. From the above mentioned facts, it seems that Mark is entitled to make a claim of unfair dismissal and get remedies. The law gives him the right to make such a claim through a trade union3. Some of the methods that would be used to address this issue may include mediation and

The director has clearly projected each and every motive of the issue through different angles. Leadership Article Example | Topics and Well Written Essays - 500 words

Leadership - Article Example ibe, he says, will attempt to maximize each person’s contribution to the organization as long as they all stay together as iron filings and focus on the organization’s core values. It is the role and responsibility of leaders in an organization to ensure that their employees are aligned toward sharing a common desire so that their efforts can be synchronized to jointly achieve goals. Alignment by Kaplan and Norton (2006) says that corporations will be more productive if the leadership realizes that the whole is more valuable than the total sum of its differentiated parts. George, Kaplan, and Logan both agree that foe effective operations in any organizational structure, employees need to work together with a shared mission and vision that should also be in sync with that of the organization so that the organization’s goals can be realized. Without such alignment, workers’ efforts will be haphazardly distributed so that no common goal can be achieved. I do agree with the three scholars on their idea about alignment. it is much easier to work with a whole team of employees whose actions, passions, ideas, goals, and agenda are all in sync with the organization’s mission, vision, and core values. This would be the perfect situation for any employee and leader and for the organization to thrive into maximum profitability. What I, however, find in all the arguments above is a normative argument of how an ideal situation for an organization would be. In a highly differentiated society with variance in generations, sex, race, socio-political-economic socialization, and liberalism in personal preferences, it is almost impossible to align employees to comply fully with an organization’s mission and vision. Leaders and employers in any organization would agree with this as an ideal situation that is so hard to come by. What leaders and employers need to do is put in measures that will ensure cooperation on the part of the employees in working toward achieving

Movie - The Secret Life of Bees and the Black Madonna Essay

Movie - The Secret Life of Bees and the Black Madonna - Essay Example The Black Madonna does serve several roles in the overall plot. As a feminine symbol, it represents maternal love and the varied mother surrogates that soothed and comforted Lily as she pondered on her relationship with her late mother and the temporal and spiritual relevance that relationship held for her. In the movie, Lily carries a picture of Black Mary that she found while rummaging through her mother’s belongings. To Lily, the picture of Black Madonna symbolized her late mother and it is this picture that eventually leads her to August, a black woman who takes her in and acts as a surrogate mother to Lily. It is August that introduces Lily to the spiritual relevance and meaning of Black Madonna, whom she considers to be the divine mother to all of the humanity. Thereby, if on the one side the picture of Black Madonna connotes spiritual and temporal maternal love and support to Lily, in the larger sense the statue of Black Madonna in this movie does convey a sentiment of love, hope and human brotherhood to a racially divided South. In a symbolic context, the statue of Black Madonna which the Daughters of Mary worship every night does convey the meaning and relevance of having faith and believing in something that transcends beyond one’s innate beliefs and yearnings. Thereby, in the movie, the statue of Black Madonna does act as a symbol of hope and reconciliation for the individual characters living in times marked by deep-seated racial divide and social tensions in the American South.
